"SAN DIEGO, Calif. (PIX11) – An empty vodka bottle was allegedly found rolling around on the floor of car that was stopped in the middle of a busy California freeway, its driver passed out behind the wheel and totally unaware of the life-threatening risk rescuers were making to get her safely out of the thoroughfare.

It happened March 27 in the northbound lanes of the 805 Freeway in San Diego. A black Chrysler Sebring was stopped in the third lane, with fast-moving traffic whizzing by on either side.

A passerby spotted the car, pulled over and called 911. Then he ran over during a break in oncoming traffic and tried to wake up the woman slumped over in the driver’s seat. The car’s windows were rolled up and the doors were locked.

“Hey, wake up!” the man shouts as he taps on the glass. The rescue was caught on camera.

Most all of the passing cars and trucks never stopped, sliding right or left to avoid a crash but still running at full speed.

“You can see cars going by 65, 70, even 80 miles per house,” California Highway Patrol Officer Jake Sanchez said. “…That was very close.”

Moments later, CHP Officer Sergio Flores arrived and he, too, tried to rouse the driver. Waiting a second for a speeding car to pass, Flores moved into position and swung his flashlight at her window. It was then that the car started rolling slowly as the driver’s foot came off the brake.

Flores ran around behind the car to rap on the passenger-side window, successfully breaking into the sedan.

“Stop your car,” he said. “You’re going to crash.”

Flores opened the side door and quickly threw the gear shift into park. He pulled the woman from the sedan and over to the curb. Officers said they found an empty bottle of vodka visible on the car’s floorboard.

The driver was identified as Amber Dlaine McKinney, 25. She was arrested on suspicion of driver under the influence."

She was arrested under "suspicion" of DUI, but can she be charged with an ACTUAL DUI violation if she wasn't seen actually driving the vehicle?

Consider the source. Cali, the land of fruits and nuts. In Michigan, if you're sitting in a non-running vehicle and you're drunk, if the keys are in it you're fucked.

Yes, you can.
This case goes even further than that one. She was behind the wheeel with the engine running and the vehicle in gear, she was driving even if she wasn't moving the vehicle...
