Facts indicate that Hillary Clinton is guilty of felonies

Regardless of the conclusions of FBI director James Comey and Attorney General Loretta Lynch, Hillary Rodham Clinton has committed a felony. That is evident from the facts and in the plain and simple language of federal statute 18 U.S. Code § 793(e) and (f).

Other not-as-important federal officials have been prosecuted for downloading classified materials onto private servers or media and taking them home, and they were charged even though those materials were never publicly released and they had no intention to do so or to harm the U.S. That statute prohibits "Gathering, transmitting or losing defense information", and that offense carries a potential penalty of 10 years imprisonment.

It's a prima facie case, meaning it is clear on the basis of known facts and the establishment of a legally required rebuttable presumption. It is understood as an evidentiary standard that measures the effect of evidence as meeting, or tending to meet, the proponent's burden of proof on a specific issue.

The bringing of charges is up to prosecutorial discretion by the U.S. Attorney General, and in some cases, the FBI investigates and decides whether and how to forward -- or not forward -- the case to the AG. But regardless of the "handling" of the case by James Comey and Loretta Lynch, Hillary Clinton is clearly chargeable for violation of federal law.

Here are just four of the statutes that Hillary Clinton seems to have violated:

18 USC §793. This statute explicitly states that whoever “entrusted with or having lawful possession or control of any document ... through gross negligence permits the same to removed from its proper place of custody ... or having knowledge that the same has been illegally removed from its proper place of custody ... shall be fined under this title or imprisoned not more than ten years, or both.” Comey called her “extremely careless”, but even by that standard, Hillary was grossly negligent with classified material. Comey claimed Hillary had no intent to transmit information to foreign powers, but that’s not what the statute requires.

18 USC §1924. This statute states that any employee of the U.S. who “knowingly removes [classified] documents or materials without authority and with the intent to retain such documents or materials at an unauthorized location shall be fined under this title or imprisoned for not more than one year, or both.” Hillary set up a private server explicitly to do this.

18 USC §798. This statute states that anyone who “uses in any manner prejudicial to the safety or interest of the United States ... any classified information ... shall be fined under this title or imprisoned not more than ten years, or both.” Hillary transmitted classified information in a manner that harmed the U.S., and keep in mind that Comey stated that she may have been hacked.

18 USC §2071. This statute says that anyone who has custody of classified material and “willfully and unlawfully conceals, removes, mutilates, obliterates, falsifies, or destroys the same, shall be fined under this title or imprisoned not more than three years.” Clearly, Hillary meant to remove classified materials from government control in a number of cases.

BOTTOM LINE: It seems obvious that Hillary Rodham Clinton was GUILTY and yet NOT GUILTY.

You know, armed with all of these facts, you should go to DC and find AG Lynch's home and present these to her personally because there is nothing any of us here can do about it. Then, I am sure we will see justice served.

Surely, you jest. The current U.S. "System Of Justice" will continue as long as Loretta Lynch remains Attorney General. And that will likely be the case should Hillary Rodham Clinton get elected in November.

Meanwhile, AG Lynch is telling BLM to not be discouraged. Laws are sometimes worth the paper they are printed on.
